8 Ad Networks Sued – A Follow-Up

Everyone who knows me, knows I’m all about being fair and If I’ve errored in any way, I will do my best to correct it.

Recently I wrote about 8 ad networks being sued and offered up my colorful opinions surrounding the lawsuit, etc.

The plaintiff (I presume) in this case has apparently come forward and posted a comment correcting my errors and to be fair, I felt I should bring those errors to the attention of MomGadget readers.

First, the man states he is not an attorney but rather a graduate student in Mechanical Engineering working on Assistive Robotics for people with high-level spinal cord injuries and also the president of Hypertouch, Inc.

Side Note: Perhaps someone can tell me why he would create an email address via his Hypertouch website as abuse2-momgadget.com@hypertouch.com? I’m not sure I feel comfortable with that!

Back to my errors – Joe states — Ad networks were sued because they were advertising using illegal UCE, specifically spam with false “From:” lines were sent under multiple domain names by a spammer with a penchant for registering hundreds of throw-away domain names, using fake names and addresses to conceal their identity.

Perhaps I can see more clearly why ad networks should be called on the carpet for allowing such activity to go on, but in my mind, I’m thinking the best way to combat this is a totally different way.

Much like the story of Sam Walton of Wal-Mart fame and how he got started, suing isn’t the answer, creating a bigger, better business is!

I’ve talked to several business owners who have been fired, belittled and dismissed by someone who thought they were the be all to end all.

It’s taken me 5 years to see the demise of a company that threw me out on false accusations, but I went about my own business, stuck to my own values and principals, provided more of what the consumers wanted and have seen first hand what hard work and true dedication can do to surpass the slimy salesman approach.

Note: Not that I wanted that company to suffer, but Karma, she is a winch!

I’ve turned away from a few businesses because I didn’t like the way they conducted business. Even when they were promising me $2,000 a month – it wasn’t worth my time nor my reputation — I said no!

The same goes with companies that stand behind their spammers. If a company has poor business practices, I will become aware of it and I will tell them exactly why I am exiting their program — then I would carry the message over to my friends who may also be a part of the program – thus the snowball starts.

There’s far better ways to skin a cat then by clogging up our judicial system with frivolous suits as such.

But that’s just my opinion.

Joe I honestly don’t know what happened. I’ve had problems with my server and it crashing every time I try to approve my comments. I’m going to dig through the archives and see if they were not just moved to an unapproved status or something. I swear I didn’t delete them

Ah, I know the pain of a balky server. I’ve had the config file of aserver get a little garbled (an extra “;” in one spot) and it’d crash, but not repeatable or predictably. Anyway, the trial happened on Monday, four defendants showed up, one didn’t (and defaulted) and three settled. I won’t hear the Judge’s decision for a few weeks I’m guessing. I did raise almost $40,000 for Darfur and the local chapter of Second Harvest (a food bank). There was a nice story in the paper about the trials. Interestingly enough, with the possible exception of Azoogle, all of the defendants still use the same spammer. A few Defendants had said “terminated” that affiliate but now the same spammer seems to just send via different affiliate ID or path.

As an additional side note, I now get daily spam to the ironically labeled “(will not be published) (required)” email address that I am using here that you posted above and I receive the first one within 48 hours of your post.

Any tips on how to prevent the spammy type stuff, I’m willing to listen.

I had no idea!
